Can a prenup be thrown out if the court doesn't think it's fair for the wife?

The reasons that I have seen prenups getting thrown out is not because it's fair or unfair.

More what the court is considered is the process.

How did you come to this agreement?

And that's why I mentioned those three factors, that if you both had an attorney on each side, you both disclosed everything, husband and wife, freely and voluntarily, without any pressure entered into this agreement, the state's not gonna throw it out.

Fairness is not the question as to whether or not a prenup is valid.

It's the procedure, it's the process that really matters.
