Does debt get divided between spouses in divorce, even if husband's name is only on house, cars, businesses?

If you didn't have a prenup and you get married and now one of you has

  • $20,000

  • $30,000

  • $40,000

  • $50,000

of credit card debt for day-to-day spending, or to maintain your lifestyle…

then yeah, that's gonna be considered marital debt.

and that's gonna also be factored in and divided between the two of you.

So like a business for example, if husband creates a business but he has all these loans.

That loan is going to be factored into the valuation of that business.

Or whatever debts he has, that's gonna be both people's responsibility.

Again, unless you get a prenuptial agreement.
