How far in advance for the signing of a prenuptial agreement is considered well in advance?
So this is the sliding scale.
The sliding scale, meaning that if two individuals have been working with a lawyer for three months and they're going back and forth, they're negotiating these terms and you end up signing it, a week before.
That week before is very different than bringing up the prenuptial agreement the week before and trying to sign it right then and there, right?
So the totality of the circumstances is going to give us insight as to what is well in advance.
It's about the facts, the circumstances, whether you've been negotiating or not.
So much so that I've even seen prenuptial agreements signed the day before the marriage, but they were working on this negotiation for the last three, four or five months.
And so that would inshaAllah be a valid prenup.
