Is it unlawful to put a condition that forbids having a second wife?
If it is unlawful to put a condition to not have any kids since that is halal, then is, it also unlawful to put a condition that forbids having a second wife?
Okay. Good question.
It is not unlawful to put a condition that forbids having a second wife.
But what does that mean?
And I've explained this in a few other videos so I won't go into detail here.
This is not a case of forbidding what is halal.
It is a case of restricting what is permissible, meaning a woman says you will not marry another woman.
And if you do, I now have the ability to ask for a divorce.
She doesn't have to exercise the ask for the divorce, but she has the right to leave the marriage because you violated a condition.
And this issue, regardless of what certain ignoramuses on the internet say, this is an issue that from the time of the tābi'een, the students of the sahaba have said was valid and was codified into the madhhab of Imam Ahmad.
And yes, there are other madhhab who allow it at times and others who don't, depending upon circumstance.
But this is not a new finagled, modern, feminist issue.
You cannot make the haram, halal. Correct.
You cannot make the halal haram, but you can restrict it.
So what's the difference between that and putting a condition to never have kids.
When you're putting in a condition to never have kids, you are denying physiology.
And one of the major objectives of marriage is to have children as the prophet
Marry, loving and fertile women.
As I am going to boast of your numbers on the day of judgment.
From this, the ulama have said that having children is one of the main objectives of marriage, but having more than one wife is not one of the main object of marriage.
Being married is an objective of Islam and marrying another wife is something which has simply been permitted.
