Is there a way to have a legal agreement regarding child custody?
No. The state owns our children.
The state has this concept called the best interest of the child. And you have agencies like DCFS that can decide what that means.
And so the state has such power over the area of child custody that there's not a single agreement that we can come up with a prenuptial agreement or anything that can guarantee the outcome of what child custody should look like.
Let's say you enter into an agreement, husband and wife sign an agreement.
At the end 10 years later the husband says, you know what? No, forget this. I'm not going to agree to this. The court is not going to enforce that. They're going to use whatever they believe is the best interest of the child.
So unfortunately, there is not a legal agreement that I am aware of regarding child custody.
