Real estate as mahr and the taxes that are owed on it?
Are taxes part of this Sadaq or did they become the responsibility of the bride?
They become the responsibility of the bride. If you own property, that property is yours.
If someone from your family were to step in and say, I'll pay the taxes for you. Then they are giving you a gift in the amount of those taxes.
But they are not responsible for them from the outset.
That responsibility is yours.
Just like, for example, women that have gold jewelry. They'll say I'm just a woman. How can I pay zakat? Because you're a Muslim.
And one of the five pillars of Islam is if you have more than the nisaab, you pay the zakat on that money that you own.
So, if you have gold, gold jewelry and a year passes and it's more than nisab you owe that.
If you don't have cash and one of your family members were to help you by paying it for you, that would be acceptable.
But the base responsibility is upon you.
So one thing you want to make sure that you do is if you're going to take real estate as a mahr, then you're going to also stipulate how the taxes are going to be paid, or you're going to maybe put it in some kind of family trust or something that's going to shield it from certain types of taxes so that it could be manageable for you.
